Two Marion County Motorcyclists Charged with DUI

motorcycle.jpgTwo motorcyclists have been arrested on suspicions of driving under the influence. At 2:00 a.m. a Marion County traffic deputy followed the Harley Davidson riders until finally pulling them over at the corner of Baseline Road and King Street. The suspect, 46 year old Dale Nelson from Ocala, fell off of his motorcycle. The deputy and the other driver, 46 year old Terry Robinson, assisted with picking the bike up off the ground because Nelson was allegedly too intoxicated to do so.

Nelson admitted to the officer that there has been a friend's death and he "probably" had too much to drink. He failed field sobriety testing and refused to participate in a breathalyzer test. Robinson, the other rider, refused field sobriety testing and would not agree to submit to a breath test. This is Robinson's fourth DUI arrest.

 

The crime of driving under the influence is a serious criminal offense not to be taken lightly. An offender risks jail time, loss of driving privileges, heavy fines and court costs, probation supervision, participation in alcohol abuse class and participate in community service. Pursuant to Florida Statute 316.193, a driver commits the crime of DUI when they are in actual control of a vehicle while impaired on alcohol or drugs. As in the case of defendant Robinson, an individual with four DUI convictions will face a third degree felony crime punishable by up to 5 years in prison.
